Terms of Service

Welcome to QuestGogo. By accessing or using our website and mobile application (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian’s consent to use the Service.

2. Accounts

You sign in to QuestGogo using your Google account. You are responsible for maintaining the security of your Google account and for all activity that occurs under your QuestGogo account. You agree to notify us immediately of any unauthorized use of your account.

3. Your Content

You retain ownership of all content you create on QuestGogo, including quests, descriptions, clues, photos, and other materials (“Your Content”). By posting Your Content on the Service, you grant QuestGogo a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute Your Content solely for the purpose of operating and providing the Service. This license ends when you delete Your Content or your account.

You are responsible for Your Content and agree that it will not:

  • Violate any applicable law or regulation
  • Infringe on the intellectual property rights of others
  • Contain harmful, threatening, abusive, or hateful material
  • Direct users to dangerous, private, or restricted locations
  • Contain misleading or deceptive information

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Place caches or create quests that require trespassing on private property or entering restricted areas
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to access other users’ accounts or private data
  • Use automated tools, bots, or scrapers to access the Service without our written permission
  • Harass, abuse, or harm other users
  • Upload malware, viruses, or other harmful content

5. Safety

QuestGogo involves real-world exploration. You acknowledge and agree that:

  • You participate in quests at your own risk and are solely responsible for your personal safety
  • You should always be aware of your surroundings and obey all local laws, traffic signals, and property boundaries
  • You should not use the Service while driving or operating machinery
  • Weather conditions, terrain, and other environmental factors may pose risks — use your judgment
  • QuestGogo does not verify the safety or accessibility of quest locations

6. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by QuestGogo and protected by copyright and other intellectual property laws. You may not copy, modify, or create derivative works from the Service itself.

7. Termination

We may suspend or terminate your account if you violate these Terms or if your use of the Service poses a risk to other users or the platform. You may delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately, but these Terms will continue to apply to your prior use.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. GPS accuracy, NFC functionality, and other location features depend on your device and environmental conditions.

9. Limitation of Liability

To the maximum extent permitted by law, QuestGogo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. This includes, without limitation, any injuries, property damage, or losses that occur while participating in quests.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Ontario, Canada.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised “Last updated” date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
